Agreement to Terms

By accessing and using the FUE India website (www.fueindia.com) and our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our website or services.

Medical Services and Consultations

FUE India provides hair transplant and related medical services. By using our services, you acknowledge and agree that:

1. All medical procedures require an in-person consultation and assessment by our qualified medical professionals.
2. Online consultations are preliminary and do not constitute a definitive treatment plan or guarantee of results.
3. Final treatment recommendations will be provided after physical examination and necessary medical tests.
4. You must provide accurate and complete medical history information for safe treatment planning.

Appointments and Cancellations

When scheduling appointments with FUE India, you agree to the following:

• Appointment Scheduling:
  • Appointments can be scheduled online, by phone, or in person.
  • We require a deposit to confirm surgical appointments.
  • Consultation appointments may require advance payment.
• Cancellation Policy:
  • Cancellations made 48 hours or more before the appointment: Full refund of deposit.
  • Cancellations made 24-48 hours before the appointment: 50% refund of deposit.
  • Cancellations made less than 24 hours before the appointment: No refund of deposit.
  • No-shows will forfeit the entire deposit.
• Rescheduling: Appointments can be rescheduled without penalty if done at least 48 hours in advance.

Payments and Refunds

All payments for services are subject to the following terms:

1. Full payment is required before any surgical procedure.
2. We accept various payment methods including credit/debit cards, bank transfers, and cash.
3. All prices are in Indian Rupees (INR) and include applicable taxes.
4. Refund policies vary based on the type of service:
   • Surgical Procedures: Refunds are only available if cancellation occurs according to our cancellation policy. Once a procedure has begun, no refunds are provided.
   • Non-surgical Treatments: Refunds for packaged treatments will be calculated on a pro-rata basis for unused sessions.
   • Consultations: Consultation fees are non-refundable once the consultation has been conducted.

Before & After Photos and Testimonials

By using our services, you agree to the following regarding photographs and testimonials:

• We may request to take before, during, and after photographs for medical documentation.
• With your written consent, we may use anonymized photographs for educational or promotional purposes.
• Testimonials provided by you may be used on our website and marketing materials.
• You can withdraw consent for use of your photos or testimonials at any time by contacting us in writing.
• We will never disclose your identity without explicit written consent.

Limitation of Liability

To the fullest extent permitted by law, FUE India shall not be liable for:

1. Any indirect, incidental, special, consequential, or punitive damages.
2. Any loss of profits, revenue, data, use, goodwill, or other intangible losses.
3. Any medical outcomes that differ from expected results, as all medical procedures carry inherent risks.
4. Any damages resulting from:
   • Your failure to follow pre- or post-operative instructions
   • Undisclosed medical conditions or medications
   • Acts or omissions beyond our reasonable control

Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service in question.

Intellectual Property

All content on the FUE India website, including text, graphics, logos, images, and software, is the property of FUE India or its content suppliers and is protected by Indian and international copyright laws.

You may not:

• Reproduce, distribute, or modify any content without our prior written consent
• Use our trademarks or logos without express permission
• Use any automated system to access our website or collect information
• Reverse engineer or attempt to extract source code from our website

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. All changes will be effective immediately upon posting to our website. Your continued use of our website or services after any changes constitutes your acceptance of the modified terms.

We will notify users of material changes through email or website notifications when required by law.

Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute arising from these terms or our services shall be resolved as follows:

1. Negotiation: Parties agree to attempt to resolve disputes through good faith negotiations.
2. Mediation: If negotiation fails, parties agree to mediation before a mutually agreed mediator.
3. Arbitration: If mediation fails, disputes shall be resolved by binding arbitration in New Delhi, India.
4. Court Jurisdiction: Any legal proceedings shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
